These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and PodcastCola (“PodcastCola,” “we,” “us,” or “our”), a podcast booking agency providing podcast guest booking, podcast outreach, and podcast PR services.

By accessing our website, submitting a payment, or engaging PodcastCola for services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. SERVICES PROVIDED

PodcastCola is a podcast booking agency and podcast PR service provider specializing in:

  • Podcast guest booking and outreach
  • Podcast booking strategy and positioning
  • Podcast pitch writing and refinement
  • Podcast PR and earned media placement
  • Podcast booking management and scheduling
  • Podcast authority and visibility campaigns

PodcastCola does not operate as a talent agency, employment agency, or public relations firm regulated under entertainment guild rules. All services are performed on a best-efforts basis subject to availability, audience fit, and editorial discretion of podcast hosts.

2. NO GUARANTEE OF SPECIFIC RESULTS (GENERAL)

Except as expressly stated in the Money-Back Guarantee section below, PodcastCola does not guarantee:

  • A specific number of podcast downloads or listeners
  • Sales, revenue, or business outcomes
  • Continued availability of any podcast show or host
  • Media coverage beyond confirmed podcast bookings

Podcast hosts maintain full editorial control over their shows. PodcastCola cannot compel any host to accept, publish, promote, or distribute an episode.

3. CLIENT OBLIGATIONS

To receive podcast booking services, Client agrees to:

  • Provide accurate biographical, professional, and positioning information
  • Respond promptly to outreach, scheduling, and preparation requests
  • Appear professionally and punctually for confirmed podcast interviews
  • Comply with podcast host guidelines and show requirements

Failure to cooperate, repeated unresponsiveness, or failure to attend scheduled interviews may void guarantees and materially breach this agreement.

4. PAYMENT TERMS

Payment terms are disclosed at checkout, proposal, or invoice and incorporated by reference.

Unless otherwise stated:

  • Fees are charged in U.S. Dollars
  • Payments are non-refundable except as expressly stated below
  • Client authorizes recurring billing where applicable

PodcastCola reserves the right to suspend services for late or failed payments.

5. MONEY-BACK GUARANTEE (LIMITED & LEGALLY ENFORCEABLE)

30-Day Performance Guarantee

PodcastCola offers a Full Money-Back Guarantee under the following strict conditions:

  1. If PodcastCola does not secure any confirmed podcast bookings for Client within the first thirty (30) calendar days from the contract inception date, Client may request a full refund of fees paid for that initial period.
  2. Client must submit the refund request in writing (email is sufficient) before the expiration of thirty (30) days from contract inception.
  3. Refund requests submitted after day 30 will not be honored under any circumstances.
  4. Refunds are limited to fees paid during the initial 30-day period only.
  5. This guarantee is void if Client:
    • Fails to respond to outreach or scheduling communications
    • Declines reasonable booking opportunities
    • Misses or cancels confirmed podcast appearances
    • Provides false, misleading, or incomplete information

No money-back guarantee applies after the first thirty (30) days.

6. SEVEN-DAY NO-PENALTY CANCELLATION RIGHT

Client may cancel this agreement for any reason whatsoever within seven (7) calendar days of contract inception.

  • No penalties apply
  • Any fees paid will be fully refunded
  • Cancellation must be submitted in writing

After the seven-day period, standard cancellation terms apply.

7. CANCELLATION AFTER INITIAL PERIOD

After the initial seven-day cancellation window:

  • Client may cancel with thirty (30) days’ written notice
  • Where disclosed in the selected plan, a one-month fee may apply
  • No refunds are provided for services already rendered or time elapsed

8. INTELLECTUAL PROPERTY

All podcast pitches, templates, outreach systems, messaging frameworks, and internal processes used by PodcastCola are proprietary and remain the exclusive intellectual property of PodcastCola.

Client receives a limited, non-exclusive license to use deliverables solely for personal or business promotion.

9. CONFIDENTIALITY

Both parties agree to maintain the confidentiality of non-public business information disclosed during the engagement, including strategies, contacts, pricing, and internal methods.

10. LIMITATION OF LIABILITY (CALIFORNIA COMPLIANT)

To the maximum extent permitted under California law:

  • PodcastCola shall not be liable for indirect, incidental, special, or consequential damages
  • Total liability shall not exceed the fees paid by Client in the three (3) months preceding any claim

Some jurisdictions do not allow limitations of liability; this provision shall apply to the fullest extent permitted by law.

11. INDEMNIFICATION

Client agrees to indemnify and hold harmless PodcastCola from any claims arising from:

  • Client’s conduct on podcasts
  • Inaccurate or misleading statements made by Client
  • Violations of third-party rights or podcast host rules

12. NO PARTNERSHIP OR AGENCY

Nothing in these Terms creates a partnership, joint venture, employment relationship, or fiduciary duty between the parties.

13. GOVERNING LAW & VENUE

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-laws principles.

Any dispute shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, and the parties consent to personal jurisdiction therein.

14. MODIFICATIONS

PodcastCola may update these Terms from time to time. Continued use of services constitutes acceptance of the revised Terms.

15. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the parties and supersede all prior oral or written agreements regarding podcast booking services, podcast PR, or podcast outreach.
